Question: Do Alternative Dispute Resolution Schemes have to give access to any personal information they hold about an individual?

Answer: If an organisation holds personal information about an individual it must provide the individual with access to that information on request, except in specified circumstances. Generally, dispute resolution schemes should give individual's access to information they hold about them. There are a limited number of situations where an organisation may deny access. More information on the requirement to provide access can be found at: at the Guidelines to the National Privacy Principles, or at Information Sheet 4 - 2001 Access and Correction and Information Sheet 5 - 2001 Access and the Use of Intermediaries.
